Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Pixoate ("Pixoate," "we," "our," or "us"), including our website, image, PDF, and document tools, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

Description of Service

Pixoate provides a suite of online tools for editing, converting, compressing, and generating images, PDFs, and documents, along with AI-powered features such as background removal, upscaling, OCR (text extraction), and translation. Some tools run entirely in your browser, while others process your files securely on our servers and delete temporary processing files automatically. Private Photo Editor uploads and editable designs stay in your account until removed under the account storage policy. We may add, modify, or remove features at any time.

Eligibility

You must be at least 16 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

Accounts

Many tools can be tried before creating an account. Continuing, downloading, saving work, subscribing and using paid capabilities may require an account.

Registration

When you create an account, you agree to provide accurate and complete information, including a valid email address, and to keep it up to date. You are responsible for all activity that occurs under your account.

Account Security

You are responsible for safeguarding your login credentials and for any use of your account. You must notify us promptly through our contact form if you suspect any unauthorized use of your account. We are not liable for any loss arising from your failure to keep your credentials secure.

Subscriptions, Billing, and Payments

Certain features of the Service are offered on a paid subscription basis. The plans, prices, and features currently available are described on our Pricing page.

Free Tier

We offer a free tier that gives you access to core tools and a daily allowance of premium features at no cost. No payment information is required to use the free tier, and no automatic billing ever occurs on it. You can read the full terms of the free tier on our Refund Policy page.

Promotional Credits and Multiple Accounts

Free-tier allowances, trial periods, referral rewards, and other promotional credits are offered once per person. We may suspend, restrict, or refuse promotional credits or free-tier benefits where we reasonably determine that multiple accounts have been created to circumvent usage limits or promotional restrictions. Account deletion and recreation do not entitle a user to receive additional promotional benefits; if you create a new account with an email address that previously held an account, your prior usage and any promotional benefits already received may be carried over to the new account.

Billing

Paid subscriptions are billed in advance on a recurring basis (for example, monthly or annually) according to the plan you select. By subscribing, you authorize us and our payment processor to charge the applicable fees and any taxes to your chosen payment method for each billing cycle until you cancel. Prices are subject to change; we will give you reasonable notice of any price change before it takes effect.

Payment Processing

Payments and subscriptions are handled by our payment provider, Paddle, which acts as the merchant of record for your purchase. We do not collect or store your full card details on our servers; that information is provided directly to and held by Paddle in accordance with their terms and privacy policy and applicable payment-card security standards. By submitting payment information, you agree to Paddle's terms in addition to these Terms.

Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation stops future billing; you retain access to paid features until the end of the current billing period, after which your account reverts to the free tier. We do not charge cancellation fees. We also offer a 14-day money-back guarantee on paid subscriptions.

Refunds are governed by our Refund Policy.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

Upload or process content you do not have the right to use, or that infringes any intellectual property or privacy rights
Use the Service to defame, disparage, or harass others, or to create or distribute other unlawful or harmful content, including CSAM or non-consensual intimate imagery
Use an AI model or its output to exploit, harm, or attempt to exploit or harm minors
Generate or disseminate verifiably false information or content with the purpose of harming others
Generate or disseminate personally identifiable information that can be used to harm an individual
Use an AI model for fully automated decisions that adversely affect a person's legal rights or create or modify a binding obligation
Discriminate against or harm people or groups based on online or offline social behavior, known or predicted personal characteristics, or legally protected characteristics
Exploit vulnerabilities associated with age or social, physical, or mental characteristics in a way that causes or is likely to cause physical or psychological harm
Use an AI model to provide medical advice or interpret medical results
Generate or disseminate information for administering justice, law enforcement, immigration, or asylum processes, including crime or fraud prediction based on profiling or indiscriminate or arbitrarily targeted use
Attempt to gain unauthorized access to the Service, other accounts, or our systems and networks
Interfere with or disrupt the Service, for example through automated scraping, denial-of-service attacks, or circumventing usage limits
Reverse engineer, resell, or commercially exploit the Service except as expressly permitted
Use the Service to violate any applicable law or regulation

Your Content and Files

As between you and Pixoate, you retain the rights you have in files and content you upload and in your original contributions to results created with the Service ("Your Content"). Pixoate does not claim ownership of Your Content. This does not give you rights in Pixoate-provided materials or third-party content included in a result. You grant us a limited license to process Your Content solely to provide the Service to you — for example, to convert, edit, analyze, or privately store a file or editable design you submit. Files required for server processing are automatically deleted within 24 hours — unless you explicitly share a result: new public links have no automatic expiration while the sharing service remains available, and end when removed or when their owning account is deleted; anyone with the link can open it, and, when you are signed in, your account keeps a small preview image and the details of each result for 7 days on the free plan or 180 days on Premium — never a copy of your file, and you can delete it whenever you like, and, if you rate a result thumbs-down and leave the investigate box ticked, that image and its result stay for up to 30 days for our team to debug, or save Photo Editor uploads and editable designs to your private account, where active saved work has no automatic expiration. Infrastructure and processing providers may handle Your Content only as needed to deliver the operation you requested. We never sell Your Content or use it to train models. You are solely responsible for Your Content and represent that you have all rights necessary to upload and process it.

AI-Powered Features

Some features use automated and AI-based processing (such as image generation, generative image editing, background removal, image upscaling, OCR, and translation). Our image generation and generative editing features use a model licensed for commercial service use. You may use your outputs commercially, but you remain responsible for the rights in uploaded material, people, brands, protected characters, and other third-party content. The AI-specific prohibitions listed in Acceptable Use above are enforceable provisions of these Terms. AI results may be inaccurate, incomplete, biased, or unsuitable for their intended context, so you must review them before relying on or publishing them. Neither Pixoate nor its model providers guarantees that an output is non-infringing or suitable for a particular use.

Intellectual Property

The Service, including its software, design, text, graphics, logos, and trademarks, is owned by Pixoate or its licensors and is protected by intellectual property laws. Pixoate-provided templates, backgrounds, illustrations, animations, icons, and other creative assets are "Pixoate Materials." The commercial license below does not transfer ownership of Pixoate Materials, grant exclusivity or trademark rights, or grant rights in third-party content. You may not copy, distribute, reverse engineer, or create derivative works of the Service itself except as permitted by law.

Commercial Finished-Work License

While your paid plan or paid pass is active, Pixoate grants you a non-exclusive, worldwide license, with no additional royalty, to use, reproduce, edit, print, publish, display, distribute, and sell Pixoate Materials only as part of finished work you create. Finished work may include advertising, websites, social media, product packaging, physical or digital end products, and deliverables for clients. You may give finished work to a client and authorize that client to use it for its intended purpose. You and your clients may continue to use, publish, sell, and distribute finished work created or exported while your paid access was active after that paid period ends, provided the applicable purchase was not refunded, reversed, or charged back. You may not sell, sublicense, share, or distribute a Pixoate Material by itself or as stock, an asset pack, a standalone source asset, a reusable template, or in another form intended to let someone use the Pixoate Material separately. You remain responsible for applicable law and for third-party rights in content you upload, request, or combine with Pixoate Materials.

Third-Party Services

The Service may rely on or link to third-party services, such as payment processors, analytics, advertising, and hosting providers. We are not responsible for the content, policies, or practices of any third party, and your use of those services is governed by their own terms and privacy policies.

Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any results obtained from it will be accurate or reliable. You use the Service at your own risk.

Limitation of Liability

To the maximum extent permitted by law, Pixoate and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of or inability to use the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars (USD 100).

Indemnification

You agree to indemnify and hold harmless Pixoate and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Termination

You may stop using the Service at any time and may delete your account from your account settings or by contacting us. If you delete your account, any active subscription is cancelled at the same time and paid access ends immediately. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users. Upon termination, your right to use the Service ends immediately; provisions that by their nature should survive — such as ownership, disclaimers, limitation of liability, and indemnification — will survive.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the jurisdiction in which Pixoate operates, without regard to its conflict-of-laws principles. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, except where applicable consumer-protection law grants you the right to bring proceedings in your place of residence.
